1. Acceptance of Terms

By accessing, browsing, or using NexVault ("the Platform," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our Platform.

These Terms constitute a legally binding agreement between you and NexVault regarding your use of our digital asset management services, including but not limited to wallet creation, cryptocurrency storage, transfers, and related features.

2. Platform Description

NexVault is a digital asset management platform that provides users with tools to:

• Create and manage cryptocurrency wallets
• Store, send, and receive supported digital assets
• Track portfolio performance and transaction history
• Exchange digital assets through our swap functionality
• Import existing wallets using seed phrases

IMPORTANT DISCLAIMER: NexVault is a simulated cryptocurrency wallet platform designed for demonstration and educational purposes. While the platform replicates real-world cryptocurrency wallet functionality, it does not execute actual blockchain transactions or store real cryptocurrency assets.

3. Eligibility

To use NexVault, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be a resident of any jurisdiction where use of cryptocurrency services is prohibited
• Not be on any government sanctions list or prohibited from engaging in financial transactions
• Provide accurate and complete registration information

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by providing a valid email address and creating a secure password. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, transaction PIN, and any recovery phrases. You agree to:

• Use a strong, unique password for your NexVault account
• Never share your login credentials with any third party
• Immediately notify us of any unauthorized access or security breach
• Securely store your recovery seed phrases offline
• Enable all available security features, including transaction PINs

4.3 Seed Phrase Security

When importing an external wallet, you will be required to provide your seed phrase. You acknowledge and agree that:

• Your seed phrase is the master key to your wallet
• Anyone with access to your seed phrase can access and transfer your assets
• NexVault will never ask for your seed phrase outside of the official import process
• You should never share your seed phrase with anyone claiming to be NexVault support

5. Services and Transactions

5.1 Wallet Services

NexVault provides wallet management services including balance tracking, transaction history, and asset management. All transactions on the platform may be subject to review and approval by our administrative team.

5.2 Transaction Processing

Transactions initiated through NexVault may be subject to:

• Administrative review and approval processes
• Processing times that vary based on network conditions
• Platform fees as disclosed at the time of transaction
• Minimum and maximum transaction limits

5.3 Fees

NexVault may charge fees for certain services, including but not limited to withdrawal fees and swap fees. All applicable fees will be clearly displayed before you confirm any transaction.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws, regulations, or third-party rights
• Using the Platform for money laundering, terrorist financing, or other illegal activities
• Attempting to gain unauthorized access to our systems or other users' accounts
• Transmitting malware, viruses, or other harmful code
• Engaging in market manipulation or fraudulent activities
• Creating multiple accounts for deceptive purposes
• Circumventing any security measures or access controls
• Using automated systems or bots without express permission

7. Risk Disclosure

By using NexVault, you acknowledge and accept the following risks associated with digital asset management:

• Volatility Risk: Cryptocurrency prices are highly volatile and can fluctuate significantly in short periods
• Regulatory Risk: Cryptocurrency regulations vary by jurisdiction and may change, potentially affecting your ability to use our services
• Security Risk: Despite our security measures, no system is completely immune to cyber attacks or unauthorized access
• Technology Risk: Software bugs, system failures, or network issues may affect platform availability or functionality
• Loss of Access: If you lose your account credentials or seed phrases, you may permanently lose access to your assets

8. Intellectual Property

All content, features, and functionality of NexVault, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of NexVault and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXVAULT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Platform
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any bugs, viruses, or other harmful code transmitted through our Platform
• Any errors or omissions in any content or functionality
• Fluctuations in cryptocurrency prices or values

11. Indemnification

You agree to indemnify, defend, and hold harmless NexVault and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Suspected fraudulent, abusive, or illegal activity
• Requests from law enforcement or government agencies
• Unexpected technical or security issues
• Extended periods of account inactivity

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NexVault is registered, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
